This is a nonimmigrant visa, granted as special protection for victims of certain crimes who have suffered substantial physical or mental abuse in the United States. This benefit is designed for those who collaborate with authorities in the investigation or prosecution of the crime.
This visa allows you to have a work permit and even legal residence (Green Card).
These are some crimes that qualify for a U visa
Domestic violence
Human trafficking
Sexual assault
Extortion
Kidnapping
Obstruction of justice or witness tampering
Malignant assault, among others
Requirements
Physical abuse
Having suffered serious physical or mental abuse.
Support for Authorities
Provide assistance to law enforcement agencies and government officials in the investigation or prosecution of criminal activities.
Location of the crime
The crime occurred within the United States or violated its laws.
Government Certification
A government agent must sign a certificate stating that the victim has cooperated with the government in the criminal case.


What does the U Visa grant?
Permanence
Allows victims to remain in the United States and access necessary state-provided services.
Temporary stay
It grants a temporary stay of 4 years, and some eventually qualify for legal permanent residence.
Protection for Victims
The purpose of this visa is to allow victims without legal status to report crimes to authorities without fear of retaliation.

Who is eligible for a U visa?
- If the applicant is under 21 years of age, his or her spouse, children, parent, and unmarried siblings under 18 years of age may apply for the U visa with the applicant.
- If the applicant is 21 years of age or older, his or her spouse and unmarried children under 21 years of age may apply for a U visa with the applicant.
If I have a U visa, can I leave the country?
If you received U visa status in the U.S. and you leave the country, you will need to go to a consulate to get an actual U visa to re-enter the U.S.
How long does the U visa process take?
The time to process applications varies, as all cases are different. In general, the government takes within 6 to 10 months to approve or deny an application for a U visa.
What comes first, the work permit or the U visa?
If you do end up getting U visa status, you will immediately receive a four-year work permit, as the U visa lasts for four years.
Which family members qualify for a U visa?
Qualified members include the spouse, children (unmarried and under 21 years of age); and parents (of a U-1 nonimmigrant who is under 21 years of age). If you are in the United States and have an approved Form I-929, you may apply for a Green Card immediately.
