Feel Protected in Your Immigration Situation
TAKE SHELTER HERE!
What has happened since Trump took office?
He has promoted a series of measures that directly affect the immigrant community in the United States, including:
1-THE EXPANSION OF “ACCELERATED DEPORTATIONS”
They allow Immigration and Customs Enforcement (ICE) to immediately deport certain immigrants without going through a court process. This policy, previously limited to the southern border, now applies nationwide to those who have been in the country for less than two years.
2-IMMEDIATE DEPARTURE OF ALL PERSONS WHO ENTERED THE COUNTRY WITH HUMANITARIAN PAROL.
The United States government requested the immediate departure of all persons who entered the country with HUMANITARIAN PAROL, although this decision was later frozen, people with this condition in the country are at risk.
3-CBP HOME APP, WHICH FACILITATES VOLUNTARY “SELF-DEPORTATION.”
The CBP HOME APP has been launched, facilitating voluntary self-deportation, allowing immigrants to notify their departure from the country, provided they declare they have the means to return to their place of origin.
4-A CONTROVERSIAL MEASURE, THE ALIEN ENEMIES ACT OF 1798
Through this measure, the president seeks to expedite the deportation of people considered a threat in the context of war. These actions have generated fear and chaos within the immigrant community, with reports of detentions while people were carrying out everyday activities such as going to work or returning home.
5-The IRS and its agreement with ICE
It has been revealed that the IRS has reached an agreement with ICE to share tax information on undocumented immigrants. The situation has led to the collapse of detention centers, which hold more than 42,000 people in ICE custody.

ICE is just around the corner.
And what happens if ICE comes to your home or your workplace?

Do you remember who is at risk?
These policies affect various groups within the immigrant community.
Undocumented immigrants: Those who have resided in the U.S. for less than two years are at greater risk due to the expansion of expedited deportations.
Beneficiaries of programs like DACA: The future of these programs is uncertain under the current administration, putting those who rely on them for legal status at risk.

How long am I protected with this service?
This service lasts for (1) one year, and if you want to renew it, you can also do so.
Can I call her whenever I need her, no matter the day or time?
Yes, you can contact us at any time. If you're detained, your family can leave us a message, even if it's in the middle of the night.
That message will reach me immediately, and I have access to all the relevant information, no matter where I am.
From there, we will begin monitoring your situation and the location of your detention.
If I am detained by immigration and call the attorney, will she be present at the location where I am?
If you have already given us the signed power of attorney, it will not be necessary for the attorney to be physically present at the detention center. This procedure will save you time and facilitate case management.
However, if bail is denied, the attorney will be required to appear at the detention center to prepare a defense and continue the proceedings.
If I am arrested at night or on a weekend, will you take my call and be able to defend me?
Yes. If you are detained overnight or on a weekend, your family should contact our office immediately, leaving a clear message with your full name and your Amparo number. I will receive that information immediately, no matter where I am, as I have access to your file at all times.
From that moment on, I will begin monitoring your situation and looking into which facility you might be detained in. However, it's important to keep in mind that, in many cases, it can take 48 to 72 hours—or even longer—before we know for sure where you are. As soon as we have that information, we will contact your family to guide them on the next step to take in your defense.
This protocol allows us to act quickly and effectively, even outside of business hours, thanks to the fact that we already have your documents and preventive plan in place.
How long will it take for you to come to my legal defense if I am detained?
As soon as we are certain where you are being held and you have signed the power of attorney, we will immediately contact your family to take the next step: preparing the contract that will allow us to formally begin the legal process to request your bail.
Generally, when an immigrant has no criminal charges and a good conduct record, bail is typically between $$3,000 and $$5,000. It's rare for bail above $$10,000 to be requested in these cases. However, if there are prior convictions, such as a DUI or domestic violence charge, the amount can be higher, and in some cases, no bail is even granted.
That's why it's so important to conduct a pre-screening. If a person has a criminal record, they should start preparing now, gathering key documents such as a court order, letters of good conduct from friends or family, and completing community service hours. These actions help build a favorable profile that can be a positive influence when applying for bail.
Do you have an emergency hotline, or what are the steps to follow to make the call?
The first thing your family needs to do is contact us immediately and give us your ICE Amparo ID number.
Since when you sign up for this service, you'll have a unique number, and that number is the one they must give us immediately. This way, we'll be able to begin finding out where the immigrant is being detained, and we'll also review all the information you've provided us during the process.
If I am arrested, will the lawyer represent me in court and help me get out on bail?
The first thing your family needs to do is contact us immediately and give us your ICE Amparo ID number.
The ICE Amparo service covers preparation and protection in the event of detention, but legal representation in court and bail arrangements require an additional contract. However, as a client of our office, you'll be eligible for special discounts on these additional services.
Can I cancel the contract at any time if I no longer need it, and what will the terms be?
Once the service is contracted and payment is made, it is not possible to cancel it or request a refund. This is because, from that moment on, an essential part of the service has already been provided: the legal evaluation of your case, delivery of the power of attorney, the ID card, the list of necessary documents, and access to preparation tools. Additionally, your information is uploaded to our system so we can act immediately in the event of an arrest.
The contract includes these conditions and guarantees that, in the event of an emergency, you and your family already have the legal support necessary to act without delay.
Does this service include any proceedings I may face after an arrest?
No. A separate contract is required.
Can I use this service to fix my immigration status in the USA?
No. Settlement of your immigration status, that is, obtaining residency, depends on other factors, such as knowing the different options for legalizing your status. The ICE Protection Service seeks to provide you with legal advice before you are detained by the Department of Immigration.
If we've already made a preventive plan, does that mean I won't be deported under this protection?
No. Having ICE protection does not automatically protect you from deportation. The purpose of protection is to help you be prepared in the event of an immigration detention.
When an immigrant has a preventive plan, a signed power of attorney, and organized documents, they can begin their defense more quickly and efficiently, avoiding spending more time in a detention center than necessary.
However, developing a legal defense before an immigration judge is a separate process, not part of ICE protection. This additional service will depend on each immigrant's personal history and whether there are legal grounds to remain in the country.
For example, many have heard about the "10-year law," which allows certain immigrants to apply for a work permit if they can prove they have lived in the U.S. for that amount of time. However, it's important not to be confused: receiving a work permit doesn't mean your case is won or that you will avoid deportation. It's possible to obtain such a permit and still be deported later.
That's why it's essential to be clear at every stage of the process and not assume that a temporary document, such as a work permit, is a permanent solution. Being informed and well-advised from the beginning can make all the difference.
How long can I be detained by ICE?
It is not possible to establish an exact time, because there simply isn't one. However, obtaining ICE protection can significantly shorten that process. Why? Because you'll already have legal power to represent you, and you'll also have the necessary documents ready to defend your case and request bail.
When a person is detained, gathering documentation is extremely difficult, as many of these documents can only be submitted in person. And in many cases, these documents are key to obtaining bail.
That's why we're providing you with a list in advance, so you can start organizing that file that everyone should have ready right now.
What will happen to my children and other family members if I am arrested?
If your children are minors, we will send you a power of attorney so you can delegate their care to people you trust.
Along with this document, you'll receive detailed instructions, as most states require the power of attorney to be signed in the presence of two witnesses and notarized.
Since the validity of this power of attorney varies by state—in some cases, it's six months and in others, up to a year—we'll also let you know the duration for your location so you can renew it or apply for a new one before it expires.
If I'm located in a different city or state than where I signed with you, what type of attorneys will assist me? Does this service include legal representation in court, if applicable?
My office is located in the state of Illinois, but as a licensed immigration attorney, I can legally assist any immigrant located within the United States.
Since the pandemic, many immigration courts have allowed virtual hearings, which has greatly facilitated the process. If you are in another state and have protection services, and the immigration judge in that state allows virtual hearings, I will be able to represent you without any problems.
Now, if you're transferred to a detention center in a state where virtual hearings aren't allowed or the judge requires an in-person appearance, we'll also support you.
We know how difficult it can be to find a lawyer in a place where you don't have a support network. That's why, thanks to my membership in the American Immigration Lawyers Association (AILA) and other organizations, I can help you contact and refer you to trusted attorneys who are close to you and can represent you in person in court.
In short, we do provide legal representation where the law allows, and when this isn't possible directly, we assist and guide you so you have the right attorney where necessary.
If I already have an immigration case, can this AIP help me or would it affect my immigration application?
Having an open immigration case doesn't prevent you from being detained by ICE. In fact, having an AIP (ICE Preventive Protection) can be very helpful, as it prepares you legally for a possible detention, even if you're already applying for a visa, a pardon, or have a valid work permit.
Many people believe that having an immigration appointment protects them, but there are documented cases in which someone has been detained even after showing up for these appointments. The AIP does not interfere with your immigration process; on the contrary, it allows you to act more quickly and in an organized manner if you are detained, avoiding unnecessary delays and complications.
If I don't have any immigration cases or citizen relatives, would this ICE Preventive Protection be of use to me?
Yes, ICE Preventive Protection can be useful even if you don't have an open immigration case or citizen family members.
If you've been in the United States for more than 10 years or have maintained a good record, you may have options to close or resolve your case favorably.
Even if you don't have any family members, many immigrants have had their cases closed or their situation reviewed favorably. This service helps you be prepared and gives you the opportunity to defend your right to remain in the country, even if you only have friends instead of close relatives.
Remember that immigration processes can be long and complicated, so being prepared with ICE Preventive Protection will allow you to act quickly if you face detention.
If I was deported and have already served my sentence, but I am in the US, does the AIP apply to me?
If you've already been deported and it's been more than 10 years, the AIP may be helpful, but with certain conditions.
In this case, you would need to sign an additional document, as ICE could attempt to reactivate the deportation. This document would help you avoid immediate deportation, although it won't always be effective.
It's important to be honest about your options, because while there are cases where you can fight deportation (for example, if you have family members with special needs or serious health problems), each situation is unique and will depend on specific factors.
If you were recently deported and returned, or if you failed to comply with deportation, this service would not apply. However, in some cases, such as those I mentioned earlier, there may be opportunities to fight for your continued residence in the country.
If I've contributed to Social Security and I'm deported, what happens to that money? What do I do with the bank accounts where I manage my money?
In these cases, it is highly recommended that you seek the advice of an attorney specializing in commercial law or property matters. They will be able to advise you on the best way to manage your bank accounts, properties, and businesses.
Additionally, if you're married, it's an excellent idea to have joint bank accounts. This is especially important in situations where, for example, the husband is arrested and the account is in his name only. In these cases, accessing money can become a real problem for the couple, even leading them to go into debt while the situation is resolved.
Having a joint account allows either partner to access the funds in an emergency without unnecessary complications. Being prepared can avoid many headaches.
What guarantees that I will have the protection of your signature at the time of an arrest?
The support of my office for over 13 years. My law license. A law license in the United States isn't easy to obtain. That's why I wouldn't risk losing it for anything in the world. For that reason, I don't offer miracles. Nor do I offer false promises. With this service, what I seek is for you to be prepared before an arrest occurs.
