These are legal remedies that a person in the process of obtaining an immigrant visa, adjusting status, or certain nonimmigrant statuses can use to have certain grounds for inadmissibility to the United States forgiven, such as re-entering after having been deported, or having remained in the country illegally for several years, among others. There are several types of pardons.
Requirements
To apply for an immigration pardon, the immigrant must:
Determine what type of forgiveness you need.
Complete the corresponding application form.
Submit the form to USCIS.
Complete Form G-1145 to receive notifications of acceptance of your application.
Who qualifies for a pardon?
In general, the qualifying relative for the purpose of a waiver must be a spouse or parent who is a U.S. citizen or legal permanent resident. In some cases, children who are U.S. citizens or legal permanent residents may also be considered qualifying relatives.


The most common types of immigration pardons are
I-601
Also known as a “waiver of inadmissibility” immigration pardon, it is used when the immigrant has certain crimes, such as immigration fraud or drug possession charges.
I-601A
It is used when the immigrant's only crime is having entered or remained in the country illegally.
I-212
It refers to the authorization to re-enter the United States after having been deported.

There are several crimes that can lead to the deportation of an immigrant in the United States. These include: Aggravated felonies: These are serious crimes that usually include sexual crimes, armed robbery, drugs, among others.
How do I know if I qualify for an immigration pardon?
To apply for the I-601 immigration waiver, you must have at least one family member who is an American citizen or permanent resident (spouse, parents, or children) who can demonstrate that they would suffer extreme hardship if the beneficiary were unable to obtain the waiver and were deported. How long does an immigration pardon take in 2024?
The processing time for I-751s depends on the USCIS office that is deciding the petition. As of March 2024, USCIS is taking between 18 to 34 months to review I-751s, including joint petitions and waiver applications.
What comes after immigration pardon?
Once the waiver is approved by USCIS (United States Citizenship and Immigration Services), the applicant should receive an information packet from the U.S. Embassy in his or her home country.
How much is the penalty for voluntary departure?
Voluntary departure becomes a formal deportation order that must be executed by an immigration judge as soon as possible. It also imposes a 10-year ban on re-entry into the United States and fines of up to $14,000.
